We have a new God, Judge Lau the Odex-iminator.

Some of you have probably read today’s Straits Times about the Odex-Pacnet issue. A landmark lawsuit was thrown out on Friday, and supporters of the Xedo Defense can iron up their balls a little and get more stuff done.
All I can say is, ZOMFG JUDGE LAU MUST BE AN ANIME FAN. LULZ.
But his ruling has certainly put a twist on the whole Odex issue.
Odex, said Judge Lau, failed on two counts.
Only copyright owners – that is, the studios that made the anime – or an ‘exclusive licensee’ for the anime being downloaded, can take legal action under the Singapore Copyright Act.
Odex is a sub-licensee and had letters from rights owners authorising it to take action on their behalf, but the firm was neither a copyright owner or an ‘exclusive licensee’.
An exclusive licensee has the sole right to distribute a product in a certain market.
Judge Lau added that he was not wholly satisfied with Odex’s explanation of how it identified the downloaders.
Seems like if you receive a letter from Odex, you can burn it and send it back to Odex because they don’t have the rights to do to do this. Which also means, people who received their letter and paid them should sue Odex back.
Those people, especially the parent of that 9 year old kid who got Odex-ed. IT’S TIME TO GET YOUR MONEY BACK. YOU GOT CHEATED. It’s like how someone sends you a letter you and tells you better pay them money because they saw you licking your cat or they’ll report you to the SPCA. Whether or not it makes sense, it doesn’t matter. You end up paying anyway for fear of prosecution. Which eventually later you’ll discover that there’s no such cat laws in Singapore.
You can lick your cat after all!
Then again, I know very little about the law (not because I’m ignorant, but I can’t even stay awake after 2 pages of the Bible, let alone the Constitution.) so I think it would be good if someone can enlighten me, and everyone else on this part.

After a couple of nudging from Zer0 who keeps telling me to put my film making experience to good use, I’m now dying to produce an anti-Odex short film. I’ve a couple of running ideas atm and I’ll need volunteers to help me up with the acting and all. We’ll probably do guerrilla shooting (ie no permits, shoot and run. A common Singaporean film technique) and it will be all done in a day if everything goes well.

Oh and if there’s more of you people out there who’s interested, do let me know. I want to get this out soon before my real project starts in a couple of weeks time. I’ll be busy working on a arthouse dance film soon so if anyone wants to do this, let me know ASAP!

i think paying up already telling the judge that the you admitted doing those things on your pc so it will be difficult to get the money back. because you have to bring the person to court and all those blah blah… it takes time and money. you might end up paying more than you paid for.
however the isp SHOULD be FINE for releasing customer information its a breach of trust. i believe in todays newspaper it stated that SINGTEL did not even send lawyer to court hearing when odex wants them to release the customer information.

Am willing to fund (to the best of my ability), and also contribute in other meaningful ways – such as mobilising support and providing transport.
A proposal: is it tall order to incorporate live-action anime parodies using cosplayers, as well as stop motion animation (using Gunpla or action figures) in the film? nch85 has got a sense of humour and would be interesting to see if he’s willing to collaborate in the project.

I thought Odex is gonna appeal? Everything isn’t settled yet.
It’s no longer just boycotting Odex. All youths in Singapore must now show the jap companies and the world that we have to cajones to boycott ALL ANIME. Find new hobby which do not involve dealing with crooks.
This link shows how unreliable BayTSP if used as evidence. They need proof for conviction and they need your harddrive, so erase those files when you do get the letter.

And for those who paid up and signed odex demands, you really gave up your rights to get your money back when you signed the confession letter…
I find it objectionable and disgusting that the Odex people are saying that they will donate to charity with the excess money collected. Are they trying to mock our Prime Minister Lee? When our PM Lee recently said he would donate part of his salary to charity it was an admirable gesture because it is his hard-earned money. When Odex people say it, it is despicable because the money they want to donate to charity comes from threatening kids as young as nine years old.
And for the last time, ANYONE here who posts in Hardware forums or something please tell everyone there this.
ODEX’S CASE HASN’T BEEN STRENGHTHENED! THEY STILL HAVE TO DEAL WITH THEIR SUB LICENSEE STATUS! All the letters from the bloody Nips and even if they bring their whole company down won’t make a iota of difference in court. Maybe they’re trying to pressure the courts and the SG govt to change the law in High Court but guess what, this is going to be hard to achieve.
First, the letters from the Japs don’t overwrite the Copyright Act as it is written. Compensation and legal action is the EXCLUSIVE RIGHT OF COPYRIGHT HOLDERS AND EXCLUSIVE LICENSEE ONLY!!. So long as ODEX remains a plantiff thus making them entitled to compensation THE CASE WON”T STAND! The Japanese can allow Odex to act on their behalf, they however cannot allow Odex to benefit in any way from it. Since Odex is naming themselves as the plantiff, they basically screwed any chance of the appeal being ruled in their favour. Someone tell those Japanese their local licensee is making them look bad in court and in the public.
So long as Odex remains front and centre of the case, PacNet will not loose and the SG govt has no reason to side Odex in this case. The law really isn’t on their side and it was written to side them in the first place. If Odex wants to sue, they will have to either get all exclusive licence or relinquish all their titles so they’re no longer a sub licensee.
Guess we won’t be seeing that anytime soon

Whatever the outcome of the legal proceedings all anime fans must remain strong in their resolve to boycott Odex and its jap friends. Since they are all out to destroy us, we must do what we can to retaliate. Do not have short memories like most adults here.
In the worst case scenario, kick the anime habit. It can be done!
Anime fans of Singapore unite! What does not kill us makes us stronger! We shall not be taken down by the Xedo Holocaust!

Something new about Odex on today’s HOME newspaper. They “change” their tactics on how to deal with downloaders. Don’t really think there is any much change with it though.
I’ve got a friend who can help you if you want; he can act a little, but he’s got A’s to complete first
